  • Extensive knowledge of legal and court policies, procedures, practices, terminology, and systems; state and federal laws, rules, and regulations; and public defense.

Responsibilities
  • Oversee and manage public defender services within assigned regions of the Conflict Defender Office.
  • Determine whether conflicts exist in referred cases and assign cases appropriately.
  • Ensure prompt counsel and compliance of public defender assignments with the Montana Public Defender Act.
  • Implement standards and procedures established by the Conflict Defender Division Administrator and the Office of the State Public Defender.
  • Maintain a client caseload as determined by the Conflict Defender Division Administrator.
  • Handle all phases of multi-forum litigation for indigent clients in typical, complex, and high-profile cases.
  • Mentor developing public defenders in their representation of indigent clients.
  • Research and prepare legal defenses based on facts, investigations, and legal research.
  • Keep clients informed and prepared for all stages of representation, including hearings, proceedings, and trials.
  • Report to the Regional Conflict Public Defender.
  • Hire and manage public defenders and support staff.
  • Oversee contract services.
  • Provide client consultation and case assessment.
  • Assess, research, and prepare legal defenses in civil, criminal, juvenile, involuntary commitment, and dependent/neglect cases.
  • Represent clients in court, trials, and official proceedings.
  • Review and prepare legal documents, opinions, forms, contracts, permits, and other legal agreements.
  • Prepare findings of fact, conclusions of law, and judgments after administrative and court proceedings.
  • Interpret and apply state and federal laws and administrative rules.
  • Interview parties, witnesses, and experts involved in legal proceedings.
  • Research and respond to questions or complaints, provide information, explain policies and procedures, and facilitate resolutions.
  • Provide consultation, recommendations, legal advice, settlement negotiations, and assistance with legal decisions.
  • Collaborate with public defenders and other attorneys during trials and hearings.
  • Provide direction and guidance on cases involving substantial legal precedent and advise on new laws without case precedent.
  • Serve as a legal advisor across multiple fields of law.
  • Ensure fiscally sound resource use in the assigned office and Conflict Division.
  • Ensure accurate and timely collection and reporting of operational data and information.
  • Ensure quality administrative management procedures are in place.
  • Review potential conflicts of interest and make final conflict determinations.
  • Ensure compliance with agency Practice Standards.
  • Ensure personnel, contractors, and clients know how to raise complaints about public defender performance.
  • Ensure proper caseload management under agency policies and procedures.
  • Assist in resolving conflicts of interest ethically and appropriately.
  • Manage sensitive public, political, and division-specific issues.
  • Supervise public defenders and support staff.
  • Ensure an active performance evaluation process for office employees and contractors.
  • Ensure employees and contractors receive training and mentoring.
  • Oversee progressive discipline in a union environment.
  • Ensure capital-case counsel assignments comply with Montana Supreme Court standards.
  • Provide training and guidance to public defenders.
  • Develop relationships with prosecutors, judges, law enforcement, corrections, elected officials, nonprofit organizations, and other interested parties.
  • Develop relationships with contract attorneys providing agency services.
  • Represent the agency at local, state, and national meetings.
  • Respond to inquiries from the media, professional organizations, and the public and defend agency decisions when needed.
  • Testify in legislative hearings about division operations, legislation, budget matters, and other agency operations.
  • Attend continuing legal education seminars to meet Bar requirements.
Desired Qualifications
  • At least five years of progressively responsible management experience, including supervision of professional and support staff, budgeting, and organizational and operational functions.
  • Practical experience in law, preferably litigation involving criminal and civil law and public defense actions.
